Court hearing for Grand Forks man shot by police officer cancelled again

The April 23 court hearing scheduled for David James Elliott has been cancelled. According to court records, the Initial Appearance hearing has been waived and a Preliminary Hearing/Arraignment has been scheduled for June 5. Elliott is charged with two felony counts of reckless endangerment and a misdemeanor count of fleeing a police officer. The bizarre case that ended in an officer involved shooting, involves strange behavior by four separate law enforcement agencies, and is under investigation by the North Dakota Bureau of Criminal Investigation (BCI). On February 28, 2015, Elliott, an unarmed man with no criminal record, was shot by a University of North Dakota police officer in front of the Altru Hospital Emergency Room in Grand Forks. Affidavits filed by police and sheriff’s deputies in the case reveal major discrepancies between the Grand Forks Police Department and Grand Forks Sheriff’s Department regarding what occurred on the night in question. The criminal charges against Elliott were not filed until March 25, 2015, although the alleged offenses took place on February 27, 2015. Elliot is yet to appear in court.
